Punjab, February 2025: One of the biggest real estate company Macrotech Developers has sued House of Abhinandan Lodha (HoABL) over the use of trademark Lodha. While Macrotech is run by Maharashtra Minister Mangal Prabhat Lodha’s older son, Abhishek Lodha,
HoABL is run by his younger son Abhinandan Lodha.Last month, Macrotech approached Bombay High Court against HoABL for infringing on trademark Lodha and sought Rs 5,000 crores in damages. The real estate giant Macrotech claimed
that HoABL and Abhinandan have been using Lodha trademark and confusing customers. They cited several instances of HoABL using Lodha name.The genesis of the dispute is separation of businesses back in 2015. According to the case filed by Macrotech
, Abhinandan separated from Lodha group or family real estate business back in 2015. Back then the real estate arm was in Rs 20,000 crore debt and considered a sinking ship by many. Abhinandan was given Rs 600 crores to start new
business. A Family Agreement was drawn up in 2017, between the four members of Lodha family. This included Mangal Prabhat Lodha, his wife Manju Lodha and sons Abhishek and Abhinandan. As per the agreement
, Abhinandan would have nothing to do with Lodha Group and would start new business. The agreement stated that Abhinandan would create distinct identity and not use Lodha name in any manner for any of his businesses.Macrotech has alleged that with Abhinandan not
conforming to the 2017 agreement, another Family Agreement had to be drawn in 2023. The 2023 agreement was signed by both the brothers. The new agreement allowed Abhinandan to use ‘House of Abhinandan
Lodha’ name. He was to make sure to not use Lodha in any other form or manner.Macrotech claims that they found that HoABL and Abhinandan were using Lodha name. From issuing ads with Lodha prominently displayed, to mentioning Lodha plots on their websites, to even registering trademarks like Lodha
Ventures, Lodha Insurance, Lodha Finserv, among others, were discovered. On this discovery, Macrotech wrote to HoABL to stop using Lodha name. HoABL refuted all allegations. This was in violation of 2023 Family Agreement.
Abhishek also wrote to Abhinandan to stop using Lodha name. Abhinandan feigned ignorance about the existence of 2023 agreement. Irked by responses from HoABL and Abhinandan, Macrotech finally approached Bombay High
Court.The High Court, after hearing both sides, urged the brothers to try mediation. A retired Supreme Court Justice has now been appointed to mediate the dispute. It will be worth watching if the mediation succeeds and brothers are able to bury the hatchet.
